Welcome to MARA AMAR.

These Terms of Service (“Terms”) apply to your use of the MARA AMAR website, online shop, products, services, workshops, classes, and other offerings provided by MARA AMAR.

By accessing or using our website or purchasing our products or services, you agree to these Terms. If you do not agree with these Terms, please do not use our website or purchase our products or services.

1. About MARA AMAR

MARA AMAR is an eco-conscious creative brand focused on art, repurposing, sustainability, creativity, and purposeful learning.

Our products and educational offerings may include handmade, upcycled, repurposed, vintage, secondhand, or otherwise unique materials.

Because many of our products are handmade or made from repurposed materials, slight variations in color, texture, appearance, stitching, markings, or other characteristics may occur. These differences are part of the unique nature of handmade and upcycled work.

2. Website Use

You may use the MARA AMAR website for lawful purposes and in accordance with these Terms.

3. Products and Product Information

We make reasonable efforts to accurately describe and display our products.

However, colors and appearances may vary depending on your device, monitor, lighting, photography, materials, and other factors.

Availability of products is not guaranteed. We may change, discontinue, or limit products at any time.

Because some MARA AMAR pieces may be handmade, upcycled, repurposed, vintage, or one-of-a-kind, an item may not be restocked once it has sold.

4. Orders and Purchases

When you place an order through our website, you agree to provide accurate and complete information necessary to process and fulfill your order.

After placing an order, you may receive an order confirmation. An order confirmation does not necessarily guarantee that an order can be fulfilled if an unexpected issue occurs, such as an inventory error, payment problem, pricing error, or other circumstance.

If we are unable to fulfill your order, we will contact you and, when appropriate, issue a refund for the affected purchase.

5. Pricing and Payment

Prices are listed on the MARA AMAR website and may change at any time.

Applicable taxes, shipping charges, and other fees will be displayed during checkout when applicable.

Payments are processed through third-party payment services, such as Stripe and/or payment services supported through our e-commerce platform.

MARA AMAR does not intentionally store your complete payment card information on our own systems.

By submitting payment information, you represent that you are authorized to use the payment method provided.

6. Shipping and Delivery

MARA AMAR may use Pirate Ship and shipping carriers such as the United States Postal Service (USPS) to fulfill and ship orders.

Customers are responsible for providing an accurate shipping address at checkout.

Once an order has been shipped and transferred to the applicable carrier, delivery times may be affected by circumstances outside of MARA AMAR's control, including carrier delays, weather, holidays, incorrect addresses, lost or delayed packages, or other shipping disruptions.

We will make reasonable efforts to assist with shipping issues and provide available tracking information.

If a package is returned to MARA AMAR because of an incorrect or incomplete address provided by the customer, additional shipping charges may apply before the order can be resent.

7. Returns, Exchanges, and Refunds

Our return, exchange, and refund practices are described in our FAQ page, which is incorporated into these Terms.

Nothing in this section is intended to limit any rights you may have under applicable law.

8. Handmade, Upcycled, and Repurposed Items

MARA AMAR may use secondhand, reclaimed, vintage, thrifted, deadstock, donated, or previously used materials.

As a result, some materials may have natural variations, previous wear, markings, imperfections, fading, or other characteristics.

When relevant, product descriptions will provide information about the condition or characteristics of an item.

These characteristics are not necessarily defects and may be part of the item's intended design or history.

9. Workshops, Classes, and Educational Programs

MARA AMAR may offer creative workshops, sewing classes, homeschool classes, family activities, and other educational experiences.

Workshop and class registration may be subject to additional information provided at the time of registration, including dates, times, locations, age requirements, pricing, materials, and cancellation policies.

Participants and, when applicable, their parents or legal guardians are responsible for providing accurate registration information.

For minors participating in MARA AMAR programs, a parent or legal guardian may be required to provide permission and any required emergency or participant information before participation.

10. Workshop Safety

MARA AMAR workshops and classes may involve sewing machines, needles, pins, scissors, fabric, crafting tools, adhesives, and other materials or equipment.

Participants are expected to follow safety instructions and reasonable directions provided by MARA AMAR, trained volunteers, and/or the host facility.

Parents or legal guardians are responsible for supervising children when required by the specific program or registration terms.

MARA AMAR reserves the right to stop a participant's activity if their conduct creates an unreasonable safety risk to themselves or others.

Additional safety requirements or waivers may apply to specific classes or workshops.

11. Intellectual Property

Unless otherwise stated, the MARA AMAR name, logo, branding, original designs, photographs, graphics, written content, educational materials, workshop materials, website content, and other original creative works are owned by or used with permission by MARA AMAR.

You may not reproduce, modify, distribute, sell, publicly display, or commercially use MARA AMAR's original content or designs without prior written permission.

Purchasing a MARA AMAR product does not transfer ownership of MARA AMAR's underlying artwork, designs, branding, photographs, or intellectual property.

12. Customer Photos, Reviews, and Submissions

If you voluntarily submit a review, photograph, testimonial, comment, suggestion, or other content to MARA AMAR, you grant MARA AMAR permission to use that content for legitimate business and promotional purposes, unless otherwise agreed.

You represent that you have the right to provide the content and that it does not violate another person's rights.

MARA AMAR will not knowingly use a child's image or personal information for promotional purposes without appropriate parental or guardian permission.

13. Third-Party Services

MARA AMAR uses third-party services to help operate our business, including e-commerce, payment, email, shipping, and other services.

These may include Big Cartel, Stripe, Google, Pirate Ship, and shipping carriers such as USPS.

Third-party services operate according to their own terms, conditions, and privacy policies. MARA AMAR is not responsible for the policies, practices, availability, or performance of third-party services.

14. Privacy

Your use of the MARA AMAR website is also subject to our Privacy Policy, which explains how information may be collected, used, disclosed, and protected.

15. Website Content and Accuracy

We strive to keep our website and information accurate and up to date. However, errors or omissions may occasionally occur.

MARA AMAR reserves the right to correct errors, update information, change product details, or modify pricing when necessary.

We do not guarantee that every piece of website content will always be complete, current, or error-free.

To the fullest extent permitted by applicable law, the MARA AMAR website and its content are provided on an “as available” basis.

MARA AMAR does not guarantee that the website will always be available, uninterrupted, secure, or free of errors.

Nothing in these Terms excludes or limits any rights or protections that cannot legally be excluded or limited under applicable law.

17. Limitation of Liability

To the fullest extent permitted by applicable law, MARA AMAR will not be responsible for indirect, incidental, special, consequential, or similar damages arising from your use of our website, products, services, or participation in our workshops, except where such limitation is not permitted by law.

Nothing in these Terms is intended to waive rights or protections that cannot legally be waived.

18. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses or claims arising from your violation of these Terms, misuse of the website, or violation of another person's rights.

19. Changes to These Terms

We may update these Terms from time to time as MARA AMAR grows, changes its services, or as necessary to reflect changes in applicable requirements.

When we make changes, we will update the Effective Date at the top of this page.

Your continued use of the website after updated Terms are posted constitutes acceptance of the updated Terms to the extent permitted by law.

20. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles, except where applicable law requires otherwise.
